State of emergency to be de facto in effect in Turkey

Some of the details of the new legislative proposal of the AKP government are revealed by the local media on July 15. The proposal suggests that the state of emergency will be de facto in effect in Turkey although the government announced that they will end it by July 18. Following a military coup attempt on July 15, 2016, the ruling AKP government announced the state of emergency and has been ruling the country with statutory decrees since then.

The new legislative proposal is comprised of 24 main articles and 4 provisional ones, and is to recommend amendments primarily in anti-terror law and the penal code.

The detention period is to be decreased to four days, that can be raised additional four days following the court hearing. During the state of emergency, the detention period was 30 days at the beginning, then it was decreased to 7+7 days.

TRUSTEES TO HAVE UNLIMITED DUTY TERM

According to the articles of the existing law, the trustees can serve three years at most in periods apart from the state of emergency. The proposal recommends that the trustees appointed to firms or organisations should be on duty until the end of the case.  

GOVERNORS TO ANNOUNCE '10 DAYS BAN'

The governors are given some important authorities by the new proposal. They will be fully authorised to announce 10 days ban on entering the province for anyone they consider 'affiliated with terror' in line with the decision of a judge.

Similarly, the governors will be able to ban all kinds of demonstrations and/or activities for 10 days.

ACQUITTED MILITARY PERSONNEL WILL NOT BE REINSTATED

The military personnel who were acquitted though their affiliation to terrorist organisations are confirmed will not be reinstated, according to the new proposal.

Turkish general staff is authorised to send these military personnel immediately to other public institutions if their reinstation is not demanded even for a limited period of time.
